محكمة مصرية تأمر بحظر "جوجل و يوتيوب" لمدة شهر من البث فى مصر-Egyptian court orders banning "Google and YouTube" for a month of broadcasting in Egypt

بعد أن قررت دائرة الاستثمار بمحكمة القضاء الإداري بمجلس الدولة برئاسة المستشار حسونة توفيق نائب رئيس مجلس الدولة‏,‏ أمس تأجيل الدعوي القضائية المقامة لوقف وإغلاق موقع جوجل في مصر.

لقيامه بالإبقاء علي الفيلم المسيء للرسول صلي الله عليه وسلم علي موقع يوتيوب المملوك للشركة إلي جلسة9 فبراير للاطلاع والمستندات والرد. كما قررت المحكمة تأجيل الطعنين المقامين من الشركة المصرية لخدمات التليفون المحمول موبينيل ضد الجهاز القومي لتنظيم مرفق الاتصالات علي القرارين الصادرين بشأن تحديد سعر الترابط للمكالمات الصادرة من المصرية للاتصالات المنتهية علي شبكة موبينيل, وتلك الصادرة من شركات التليفون المحمول الثلاث المنتهية علي شبكة المصرية للاتصالات لجلسة السبت23 فبراير.

أمرت محكمة القضاء الإداري المصرية، السبت، بحظر موقع "يوتيوب" على الإنترنت بسبب نشره فيلما مسيئا للإسلام أثار موجة من الاحتجاجات في عدد كبير من البلدان الإسلامية.

وطلبت الدائرة السابعة في محكمة القضاء الإداري برئاسة المستشار حسونة توفيق نائب رئيس مجلس الدولة، إلزام الحكومة باتخاذ الإجراءات اللازمة لحظر ووقف عمل موقع يوتيوب في مصر لمدة شهر، وذلك بعد شكوى رفعها حامد سالم اتهم فيها "يوتيوب" بالوقوف وراء "تهديد السلم الاجتماعي" من خلال عرض الفيلم.

ويوتيوب التابع لعملاق الإنترنت الأمريكي غوغل، محظور في باكستان منذ ايلول/سبتمبر، بعد رفض الموقع الاستجابة لـ"طلب" الحكومة الباكستانية سحب الفيلم الذي اعتبر مسيئا.

YouTube's U.S. Internet giant Google, is banned in Pakistan since September, after the site refused to respond to "request" the Pakistani government to withdraw the film, which was considered offensive.

وقرر الموقع فقط الحد من مشاهدة الفيلم في عدد من البلدان، وخصوصا في مصر وليبيا واندونيسيا والسعودية.

The site only decided to reduce from watching the film in a number of countries, especially in Egypt, Libya, Indonesia and Saudi Arabia.

وكان حامد سالم قد أقام الدعوى ضد كل من رئيس مجلس الوزراء ووزير الاتصالات وتكنولوجيا المعلومات ورئيس الجهاز القومي لتنظيم الاتصالات، بصفتهم، التي أكد فيها أن أعداء الإسلام والمسلمين قاموا بإنتاج وعرض مقاطع لفيلم يسيء للرسول الكريم سيدنا محمد صلى الله عليه وسلم.

Hamed Salem had filed a lawsuit against both the Prime Minister and the Minister of Communications and Information Technology and head of the National Telecommunications Regulatory Authority, as that in which he stressed that the enemies of Islam and Muslims have produced and clips of the film offends the Prophet Muhammad peace be upon him.

حظر موقع يوتيوب بسبب نشره فيلما مسيئا للإسلام أثار موجة من الاحتجاجات في عدد كبير من البلدان الإسلامية.

وطلبت الدائرة السابعة في محكمة القضاء الإداري برئاسة المستشار حسونة توفيق نائب رئيس مجلس الدولة، إلزام الحكومة باتخاذ الإجراءات اللازمة لحظر ووقف عمل موقع يوتيوب في مصر لمدة شهر، وذلك بعد شكوى رفعها مصري اتهم فيها يوتيوب بالوقوف وراء "تهديد السلم الاجتماعي" من خلال عرض الفيلم. وقد تعذر الاتصال بالمتحدث باسم الحكومة على الفور للإدلاء بتعليق على هذه المعلومات.

يذكر بأن موقع يوتيوب محظور في باكستان منذ سبتمبر، بعد رفض الموقع الاستجابة لطلب الحكومة الباكستانية سحب الفيلم الذي اعتبر مسيئا، وقرر الموقع فقط الحد من مشاهدة الفيلم في عدد من البلدان.

قضت دائرة الاستثمار بمحكمة القضاء الإداري بمجلس الدولة برئاسة المستشار حسونه توفيق نائب رئيس مجلس الدولة يوم "السبت" ، بإلزام الحكومة ممثلة في وزارتي الاتصالات والاستثمار ، بوقف عمل موقع "يوتيوب" على شبكة الانترنت لمدة 30 يوما من تاريخ صدور هذا الحكم وقطع إشارة استخدامه على شبكة الإنترنت ، وذلك بسبب تعمده عرض الفيلم المسيء للاسلام والرسول رغم صدور قرارات بوقف عرض هذا الفيلم على هذا الموقع.

قالت المحكمة في أسباب الحكم إنه ثبت لديها من واقع الأوراق التي قدمها مقيم الدعوى، أن موقع اليوتيوب أصر على تداول الفيلم المسيء للدين الإسلامي والرسول ولم يحترم عقيدة الملايين في مصر ، وتجاهل حالة الغضب التي سادت بين جموع المسلمين، ولم تقم جهة الإدارة باتخاذ أي اجراءات ضد هذا الموقع من منع الفيلم من عرضه على الموقع.

قررت محكمة مصرية السبت بحظر موقع يوتيوب على الانترنت بسبب نشره فيلما مسيئا للاسلام، وطلبت الدائرة السابعة في محكمة القضاء الإداري برئاسة المستشار حسونة توفيق نائب رئيس مجلس الدولة، الزام الحكومة باتخاذ الإجراءات اللازمة لحظر ووقف عمل موقع يوتيوب فى مصر لمدة شهر، وذلك بعد شكوى رفعها محامي مصري اتهم فيها يوتيوب بالوقوف وراء "تهديد السلم الاجتماعي" من خلال عرض الفيلم.

واعتبر المحامي صاحب الدعوى أن ذلك الفيلم الذي عرضه المواقع  حربا على الإسلام والمسلمين، كما أنه يساعد على إشعال الفتنة الطائفية في مصر.

The court said the reasons for judgment that has been proven to have the reality of papers presented by a resident of the case, that YouTube insisted on trading film abuser of the Islamic religion and the Prophet did not respect the faith of millions in Egypt, and ignore the anger that prevailed among the Muslim masses, did not administrative body to take any measures against this site to prevent the film from display on the site.

Decided Egyptian court Saturday to ban YouTube website for publishing a film offensive to Islam, and requested the seventh circle in the Administrative Court, headed by Judge Hassouna Tawfiq vice premier, forcing the government to take the necessary measures to prohibit and stop the work site YouTube in Egypt for a month, after a complaint filed Egyptian lawyer accused YouTube of being behind the "threat to social peace" through the film.

The applicant's lawyer considered that the film, which currently sites a war on Islam and Muslims, it also helps to ignite sectarian strife in Egypt.
